{"id":11504,"date":"2014-11-02T03:44:31","date_gmt":"2014-11-02T03:44:31","guid":{"rendered":"https:\/\/viconsortium.com\/?p=11504"},"modified":"2014-11-02T10:36:53","modified_gmt":"2014-11-02T10:36:53","slug":"superior-court-rules-against-mapp-supreme-court-appeal-coming-monday","status":"publish","type":"post","link":"http:\/\/wp.viconsortium.com\/?p=11504","title":{"rendered":"Superior Court Rules Against Mapp; Supreme Court Appeal Coming Monday"},"content":{"rendered":"<p>The Superior Court of the Virgin Islands in St. Thomas Saturday ruled against Kenneth Mapp in the gubernatorial candidate&#8217;s attempt to secure a temporary restraining order, preliminary injunction, permanent injunction and declaratory relief against the V. I. Board of Elections to allow the use of the DS200 voting machines on Nov. 4, as mandated by Virgin Islands law. The case was dismissed with prejudice, meaning the Superior Court will not hear it again.<!--more--><\/p>\n<p>This means that voters will not have the opportunity to verify their votes by use of the machines. Instead, after votes are cast on paper ballots, those ballots will be placed into a secure bin and later be tabulated by elections officials.<\/p>\n<p>The case will be appealed to the Supreme Court on Monday, but according to Mapp&#8217;s campaign manager, Frankie Johnson, it is unclear if there is enough time for the Supreme Court to hear the case. Johnson said he\u00a0believes that\u00a0because of the Superior Court&#8217;s ruling, Virgin Islands&#8217; voters will be disenfranchised on Tuesday.<\/p>\n<p>According to information obtained by the\u00a0<em>VI Consortium<\/em>, Tonjia Coverdale, Ph.D&#8211;who resigned her post as\u00a0election technology territorial coordinator of the Elections System of the Virgin Islands on Friday, Oct. 30&#8211;testified at Saturday&#8217;s hearing that the DS200 machines were working in accordance to VI Code. Her testimony, however, was not enough to convince the Superior Court judge that the Joint Boards of Elections&#8217; decision to use the DS200 machines in a modified way by not allowing voters to place their ballots into the tabulators themselves, was unlawful.<\/p>\n<p>The <em>VI Consortium<\/em> will continue to follow this story and provide\u00a0details as they become available.<\/p>\n<p><strong>Dr. Coverdale&#8217;s Story<\/strong><\/p>\n<p>At a chaotic\u00a0Joint Boards of Elections meeting Thursday morning on St. Thomas, Dr. Tonjia Coverdale, election technology territorial coordinator of the Elections System of the Virgin Islands, exited the room visibly upset\u00a0after attempting to give a presentation about why the DS200 machines were good to use on Election Day. Late Thursday\u00a0night, the <em>VI Consortium<\/em> obtained a resignation letter Dr. Coverdale submitted to Elections Supervisor Caroline Fawkes.<span id=\"more-11434\"><\/span><\/p>\n<p>In the letter, Dr. Coverdale chastises the Joint Boards for what she says is its attempt to discredit the DS200 voting machines, and holds strong to her stance\u00a0that \u201cthe machines are logically operating identical to the voting machines that were previously used, in which there was no violation of the Virgin Islands Code, and remain in accordance to the Virgin Islands Code.\u201d<\/p>\n<p>Dr. Coverdale was 15 minutes into her presentation on Thursday explaining how the DS200 machines work, when disputes began between her, certain Board members and Assistant Attorney General Kimberly Salisbury.<\/p>\n<p>Coverdale demanded respect be shown to her, eventually exiting the meeting, visibly upset. Certain Board members called for her resignation, including Arturo Watlington, Jr., who commenced an unabridged conversation with Fawkes while this reporter listened on. Fawkes warned him that the conversation was being recorded, but Watlington said he did not care.<\/p>\n<p>\u201cMs. Fawkes, I don\u2019t know what is going to happen now, as a result of what happened,\u201d Watlington Jr., said, speaking of Dr. Coverdale\u2019s presentation refuting the Board\u2019s claim that the DS200 machines are dysfunctional.<\/p>\n<p>\u201cWhen you have an employee who, in fact, is trying to buck a policy that has already been decided upon, and is trying to do everything to distort what the Body has already decided on, it\u2019s a very dangerous thing,\u201d Watlington said. \u201cWe explained to her why we are doing what we are doing, she disagrees, okay, it\u2019s not her call anymore.\u201d<\/p>\n<p>Watlington went on to suggest that Fawkes and Dr. Coverdale might have planned the presentation, but Fawkes fired back, saying, \u201cMe ain\u2019t plan nothing with nobody \u2014 I don\u2019t know what the lady [was] going to present. I\u2019m just saying there was a point in the presentation, where she would explain the problem.\u201d<\/p>\n<p>Fawkes also reminded Watlington that it was the Joint Boards who raised the motion to allow Dr. Coverdale to give her presentation, saying, \u201cIt was to explain the process,\u201d and that she did not know what Coverdale was going to say. Fawkes added that she was surprised by Dr. Coverdale\u2019s presentation, however Watlington said he saw it coming.<\/p>\n<p>\u201cNo, she did not surprise me because I knew where she was going,\u201d he said. \u201cBecause we had the discussion [Wednesday] morning and I suspected it. [I told her], \u2018Ms. Coverdale, you are trying to make a policy decision to reverse a policy decision that has already been made by the Board\u2019.\u201d<\/p>\n<p>In her resignation letter, Dr. Coverdale said she remains \u201cextremely disappointed\u201d that after trying to explain the compliance of the DS200 with the Virgin Islands Code to members of the Joint Boards of Elections, she has been dismissed and \u201coutright refuted with uninformed logic.\u201d<\/p>\n<p>She continued: \u201cThus, it appears to me that there is a subjective rational for their decision to underutilize the DS200 voting machines, which is of great cause of concern for me.\u201d<\/p>\n<p>Dr. Coverdale listed a myriad reasons why the DS200 machine is in compliance with Virgin Islands Code, and noted the very same machine is being utilized in 14 states on the mainland.<\/p>\n<p>She added: \u201cI pride myself as a technologist on my impeccable ethics and values and as such, I cannot allow myself to remain in a situation that may compromise my professional credibility both here in the U.S. Virgin Islands or elsewhere.
