{"id":13635,"date":"2014-12-03T10:47:16","date_gmt":"2014-12-03T10:47:16","guid":{"rendered":"https:\/\/viconsortium.com\/?p=13635"},"modified":"2014-12-03T12:08:20","modified_gmt":"2014-12-03T12:08:20","slug":"hovensa-and-its-subcontractors-give-employees-90-day-notice","status":"publish","type":"post","link":"http:\/\/wp.viconsortium.com\/?p=13635","title":{"rendered":"HOVENSA And Its Subcontractors Give Employees 90-Day Notice"},"content":{"rendered":"<p>As HOVENSA makes preparation to shut down the facility that it has used as an oil storage terminal since announcing it would cease oil refining operations in 2012, the company on Tuesday gave its remaining employees, approximately 100 workers, a 90-day notice letter, informing them that come March 1, their services will no longer be needed, sources close to the <em>VI Consortium<\/em>, who requested anonymity because they were not authorized speak on the matter, have revealed.<\/p>\n<p>Subcontractors have also given\u00a0notice to its employees and the\u00a0<em>VI Consortium<\/em>\u00a0has obtained a copy of the letter issued by Pinnacle Services, LLC, which can be viewed below. As of press time, it was unknown the total number of\u00a0subcontractor employees who are expected to be affected by this move.\u00a0<!--more--><\/p>\n<div id=\"attachment_13644\" style=\"width: 235px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/viconsortium.com\/wp-content\/uploads\/2014\/12\/pinnacle.jpg\"><img aria-describedby=\"caption-attachment-13644\" loading=\"lazy\" class=\"size-medium wp-image-13644\" src=\"https:\/\/viconsortium.com\/wp-content\/uploads\/2014\/12\/pinnacle-225x300.jpg\" alt=\"A 90-day notice letter from Pinnacle Services, a HOVENSA subcontractor, to its employees. Click image for wider view.<\/p><\/div>\n<p>HOVENSA <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/viconsortium.com\/business\/hovensa-announces-gas-depletion-dates-issues-letter-to-customers\/\" target=\"_blank\">recently<\/a><\/span>\u00a0issued a notice to its truck rack customers and haulers informing them of the plant\u2019s preparation for shutdown \u201cgiven HOVENSA\u2019s deteriorating financial condition.\u201d To that end, HOVENSA said it will no longer purchase any more gasoline and that its current supply is expected to\u00a0end on the following dates:<\/p>\n<p>Regular- Jan. 5<\/p>\n<p>Premium \u2013 Jan. 7<\/p>\n<p>ULSD \u2013 Feb. 12<\/p>\n<p>Effective immediately, HOVENSA said it will limit the fuel purchases of its customers.<\/p>\n<p>The move comes as the Atlantic Basin Refining Operating Agreement signed by Governor de Jongh and is awaiting ratification in the 30th Legislature, has yet to come up for an up or down vote, something <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/viconsortium.com\/business\/de-jongh-responds-to-hovensas-decision-to-shutdown-fuel-truck-rack\/\" target=\"_blank\">de Jongh said<\/a><\/span>\u00a0is now up to the Senate to decide.<\/p>\n<p>&#8220;The Operating Agreement negotiated by my Administration and Atlantic Basin Refining remains before the 30th Legislature for whatever further analysis and deliberations are deemed required by the Senate Finance Committee,&#8221; he said. &#8220;It also remains the decision of the 30th Legislature to determine whether any possible misgivings about the selected buyer, ABR, outweigh the risks that will come if there is no sale of the refinery, no prompt payment of the $45 million to be paid at the closing, and the failure of the Government to obtain a release of claims from the owners of HOVENSA, which would leave the Government without those releases standing between the Government and HOVENSA\u2019s claims that it is entitled to tax refunds totaling in the hundreds of millions of dollars.&#8221;<\/p>\n<p>Some senators have advocated for the decision to be left to the incoming 31st Legislature, but <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/viconsortium.com\/politics\/leaving-abr-vi-decision-to-next-administration-is-disowning-responsibility-de-jongh-says\/\" target=\"_blank\">de Jongh countered<\/a><\/span>, saying <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/viconsortium.com\/business\/senate-president-malone-says-hovensa-deal-should-be-left-to-incoming-governor-public-hearings-should-be-held\/\" target=\"_blank\">such a move<\/a><\/span> amounts to the Senate &#8220;abdicating&#8221; its responsibility.<\/p>\n<p>He added: &#8220;There\u2019s enough that the 31st Legislature is going to have to deal with and the new Governor is going to have to deal with. Some issues that were not taken up by this Legislature, such as pension reform, workers compensation legislation, unemployment trust legislation\u2013those are the issues that have to be addressed very clearly, and that\u2019s well recognized, [so] why should we have to pile more on top of them?<\/p>\n<p>&#8220;We have a responsibility [and] it\u2019s very clear where we have to go in terms of at least let\u2019s make a decision, and let\u2019s make an informed decision, and the senators now have basically said we want to make an informed decision, and whatever that decision is, we will go forward.&#8221;<\/p>\n<p>After HOVENSA announced it would stop providing fuel to the Virgin Islands, <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/viconsortium.com\/featured\/st-croix-senators-respond-to-hovensas-planned-fuel-shutoff\/\" target=\"_blank\">some senators responded with their thoughts on the matter<\/a><\/span>, including Senator Nereida &#8220;Nellie&#8221; Rivera-O&#8217;Reilly, who called on the de Jongh administration to take legal action against HOVENSA.<\/p>\n<p>&#8220;There has to be national and international attention given to this latest threat by Hovensa, who I consider a corporate bully,&#8221; Rivera-O\u2019Reilly told the <em>VI Consortium<\/em>.<\/p>\n<p>&#8220;The owners refuse to provide a copy of the sales agreement and the title commitment,&#8221; the four-term senator said. &#8220;They refuse to provide financial statements evidencing the alleged losses from the storage terminals.&#8221;<\/p>\n<p>&#8220;Moreover,\u201d Rivera-O\u2019Reilly continued, &#8220;the Government refuses to address the more than $200 million in corporate taxes owed by the refinery, which was revealed from an audit conducted by the VIBR on the heels of Hovensa\u2019s attempts to claim a tax refund of more than $200 million.&#8221;<\/p>\n<p>Freshman Sen. Judi Buckley, who did not seek a second term, also offered her thoughts on HOVENSA\u2019s planned shutdown of gas.<\/p>\n<p>\u201cHaving learned today that HOVENSA will not be purchasing any more fuels due to a cash shortage and our current supply will run out early next year, I\u2019m very concerned about the situation given they have the only truck rack on St. Croix,\u201d she said, adding, \u201cA solution will have to be reached soon, whether it\u2019s a court injunction forcing them to maintain the rack, or if it looks like ABR (the buyers) are going to be able to purchase the refinery, perhaps they\u2019ll lease the rack.
