ST. THOMAS — V.I. Superior Court Judge James Carroll III today sentenced Alan Archibald to a term of life imprisonment for raping and impregnating a minor, the court announced via press release Friday.<\/span><\/p>\n

On April 7, Mr. Archibald, 44, was convicted by a jury of second-degree aggravated rape and incest.<\/span><\/p>\n

At the sentencing hearing, Assistant Attorney General James Connor, Jr. asked the court to sentence Mr. Archibald as a habitual offender, based on Title 14 VIC \u00a7 61. \u00a0In his allocution, Mr. Connor told the court that Archibald now qualifies as a habitual violent offender and outlined the defendant\u2019s history of rape convictions.<\/span><\/p>\n

\u201cA review of the defendant\u2019s history shows that in 1991, he was 19 and was convicted of aggravated rape; the victim was 10 years old,\u201d Mr. Connor said. \u201cOn January 29, 2002, he was convicted of aggravated rape and sentenced to eight years\u2026 The defendant has never once shown one bit of remorse\u2026The defendant rapes kids. \u00a0He has been given chances, he has been given leniency and it has not worked. \u00a0There is only one way to prevent him from doing it again\u2026 The people of the Virgin Islands are recommending life imprisonment.\u201d<\/span><\/p>\n

The court also heard from the victim who begged the court not to impose a life sentence.<\/span><\/p>\n

\u201cHe repeatedly did a crime,\u201d she said, \u201cI know he has to serve time, but I don\u2019t think he deserves life.\u201d <\/span><\/p>\n

Social worker at the Department of Justice, Elma Brathwaite, disagreed with the victim\u2019s plea for mercy.<\/span><\/p>\n

\u201cYour honor,\u201d she said in her statement to the court as a victim advocate, \u201cI just hope that you will not give this defendant another opportunity to destroy more\u2026 lives because his history shows that he will not stop. He should never be around children again\u2026\u201d<\/span><\/p>\n

Candace Robinson, a social worker in the Division of Family and Children Services at the Department of Human Services, also addressed the court.<\/span><\/p>\n

\u201cIn my professional opinion, Alan Archibald has indeed demonstrated he is a habitual offender,\u201d she said. \u201cHe is a threat to young teenage girls and I think the court must send a strong message to Alan Archibald that this behavior must stop because it seems he can\u2019t stop himself.\u201d<\/span><\/p>\n

In handing down his sentence, Judge Carroll told Mr. Archibald that while he has taken some responsibility, the court has no alternative but to hand down the mandatory maximum sentence.<\/span><\/p>\n

\u201cI will, under the habitual offenders\u2019 statute, sentence you to a term of life imprisonment,\u201d Carroll said. \u201cYou don\u2019t just destroy a child physically, but also psychologically. \u00a0Victims of these types of sexual crimes rarely can go on. People develop severe psychological disturbances because of these types of crime.\u201d<\/span><\/p>\n

According to the evidence presented at trial, between 2010 and 2011, Mr. Archibald repeatedly raped the 13-year-old girl and impregnated her.<\/span><\/p>\n

Mr. Archibald apologized to his family in open court.<\/span><\/p>\n

\u201cMy family that sits in the court at this time, I see them as all victims of this situation,\u201d he said, as he turned to face his family members seated in the gallery. \u201cI\u2019m here apologizing to my kids. I just wanted to tell you all that I\u2019m sorry.\u201d<\/span><\/p>\n

Mr. Archibald said he \u201cshould have been a better father in the past, but I wasn\u2019t,\u201d and said \u201cthe day will come when I will prove myself. My final words is I\u2019m sorry and I hope you all can forgive me.\u201d<\/span><\/p>\n

In commenting on the outcome of the matter, Attorney General Claude Earl Walker said, \u201cThe defendant is an unrepentant child molester who was given many chances to redeem himself, but he refused to change, and so, for the good of Virgin Islands society, he needs to be locked away for life. \u00a0This sentence should serve as a deterrence to those who believe that it is open season on our children.\u201d \u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
