THOMAS &#8212; Federal Judge Ruth Miller on Thursday ordered former Senator Wayne James to remain in federal custody pending trial, basing her decision on Mr. James being a flight risk because his ties to the territory, she opined, were scant.<\/p>\n<p>Judge Miller said there&#8217;s\u00a0a genuine concern that Mr. James would not appear in court for his trial, if she were to allow him to be released on bail. She cited Mr. James&#8217;s lack of employment in the territory, his lack of residence, and his connections to non-U.S. nations, as some of the reasons why he might try to escape if released.<\/p>\n<p>Mr. James, 55, was indicted on October 1, 2015, with two counts of wire fraud and one count of federal program embezzlement.<\/p>\n<p>According to a federal indictment, from 2009 to 2011, Mr. James served as chair of the Senate Committee on Youth, Education and Culture in the 28th Legislature. While serving as the chair, Mr. James allegedly obtained tens of thousands of taxpayer dollars for the purpose of acquiring and translating historical documents related to the \u201cFireburn,\u201d an 1878 uprising by freed slaves in St. Croix.<\/p>\n<p>The indictment alleges that Mr. James submitted false documents to the Legislature and received cash advances in order to conduct historical research on behalf of the people of the Virgin Islands. Mr. James embezzled the cash advances for his own personal benefit instead of using them for the intended purposes, according to the indictment.<\/p>\n<p>An indictment is merely an allegation, and the defendant is presumed innocent until proven guilty beyond a reasonable doubt in a court of law, according to the U.S. D.O.J.<\/p>\n<p>Italian paper\u00a0Gazzetta Di Modena\u00a0<a href=\"http:\/\/gazzettadimodena.gelocal.it\/modena\/cronaca\/2016\/06\/29\/news\/ex-senatore-usa-arrestato-a-nonantola-1.13742276?ref=hfmomoec-10\" target=\"_blank\">showed Mr. James being taken into custody<\/a> by Italian police late June.\u00a0Mr. James,\u00a0who once lived in the province of Pisa, sponsored an amateur football team in Italy, according to the paper. He was traced to an apartment in Nonantola, Italy, where he was a guest of some friends in the city of\u00a0<span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/en.wikipedia.org\/wiki\/Modena\" target=\"_blank\">Modena<\/a><\/span>, and was intent on writing a book titled \u201cManly Manners\u201d, which contains a chapter dedicated to\u00a0traditional balsamic vinegar of Modena.<\/p>\n<p>The FBI, Office of the Virgin Islands Inspector General and Internal Revenue Service-Criminal Investigation are investigating the case. Trial attorneys Amanda R. Vaughn and Justin D. Weitz of the Criminal Division\u2019s Public Integrity Section and the U.S. Attorney\u2019s Office of the District of the Virgin Islands are prosecuting the case. Cristina M.
