Today, the Department of Labor announced that the deadline has expired for former employees to file claims in the Virgin Islands Government’s settlement with Triangle Construction & Maintenance, Inc. Labor officials thanked all the affected former Triangle employees for meeting the Feb. 12 cutoff date.
On Feb. 3, the government announced that a settlement had been reached in its case against Triangle, stemming from a 2011 suit the government brought against the HOVENSA contractor for violations of the Virgin Islands Plant Closing Act (VIPCA).
In part, the government and Triangle came to an agreement for the settlement of severance pay for certain former Triangle employees. However, the settlement required arbitration to resolve the dispute of other former employees’ entitlement to severance pay under the VIPCA, according to information released from Government House. After several months of meetings, both parties were able to amicably resolve their issues.
Even with this announcement, the government remains in court with Triangle to enforce the settlement, and promises to “do its part to ensure that the terms and conditions of the Settlement are adhered to and satisfied.”
