ST. THOMAS — V.I. Superior Court Judge Michael Dunston granted bail to a 58-year-old woman who is accused of killing her husband a little more than 11 years ago.
Vivian Stuart of Heritage Hill Condominiums made her initial court appearance before Judge Dunston Friday morning to be advised of her rights following her arrest Thursday afternoon on a warrant signed by V.I. Superior Court Judge Kathleen Mackay. Based on the police affidavit in support of the arrest, Judge Dunston found that there was probable cause to move the case forward.
Vivian Stuart faces charges of first-degree murder, first-and-third-degree assault (both crimes of domestic violence) and possession of a dangerous weapon during the commission of a crime of violence in connection with the June 25, 2005, murder of her husband, Egbert Stuart. The case was investigated by the Cold Case Unit of the Virgin Islands Police Department.
Attorney General Claude Earl Walker sought to have the court set bail in the amount of $1 million, arguing that Stuart is a danger to the community and a very high flight risk given her ties outside the Virgin Islands and the charges she faces.
At the end of the hearing, Judge Dunston set bail at $100,000 and imposed a number of conditions, which include home confinement with electronic monitoring, if she is able to secure her release.
Vivian Stuart is scheduled to appear in court on Oct. 3 for her arraignment hearing at which she will formally answer to the charges.
